Tom Walters

Tom Walters

Before joining HFW in 2002, Tom worked for seven years for a naval architecture practice on the UK’s south coast designing superyachts. Tom regularly deals with yacht casualties, insurance claims and transportation disputes. His technical background means he has also been involved with a number of technical cases and construction disputes concerning yachts. Tom advises on the use of Maritime Autonomous Systems (MAS) technology in response to the increasing demand for autonomous underwater vehicles (AUVs) and Autonomous Surface Vessels (ASVs). Tom is a member of The Royal Institution of Naval Architects (RINA) and works with the Society of Underwater Technology (SUT) advising on various legal issues. He is also a member of various SUT Sub-Committees, including Salvage & Emergency Subsea Response and Technology and Innovation.

Mark is a Senior Manager & Senior Master Mariner and forms part of our shipping emergency response team. Before joining HFW, Mark had 17 years seagoing experience, and has sailed as Master on high speed passenger vessels and freight RoRo vessels. 1. Call 911

The first thing you should do after a yacht accident is call 911. If there are any injuries, it is important to get medical help to the scene as soon as possible. The police will also come and make an accident report. This report will be an important piece of evidence in your personal injury case.

2. Check for Injuries and Offer Aid

If you are involved in a boating accident in Florida, the law requires you to give all possible aid to others who are injured or in danger. You also need to make reasonable efforts to locate the other vessel’s owner and anyone else who may be affected. Leaving the scene of a boating accident where someone is injured without doing these things can result in a criminal third-degree felony charge.

3. Document the Scene of the Boating Accident

If you are physically able, you should take steps to document the scene. Take pictures, get contact information, and talk to witnesses. Over time, evidence can be lost and memories can fade, so it’s important to document this information as early as possible.

4. File a Boating Accident Report

Florida law requires the operator and/or owner of a vessel to file an accident report with the Florida Fish and Wildlife Commission’s Division of Law Enforcement or the area sheriff/police department within:

  • 10 days if there is more than $2,000 in property damage or a complete loss of the vessel

Yachts are certainly big business throughout Florida, and it typically takes several crewmembers to maintain and operate the vessel. Crewmembers and their families should be aware that they are protected by the same laws that protect commercial ship crewmembers.

Maritime Law’s Definition of “Seaworthy”

Maritime law requires the owner of a vessel to ensure that the vessel is seaworthy. Examples of unseaworthiness include:

  • Instability of the vessel
  • Lack of safety equipment
  • Unsanitary conditions
  • Lack of proper procedures, rules, or regulations
  • Lack of warning signs
  • Trip hazards and inadequate railings
  • Incompetent, inadequate, or dangerous crew
  • Noncompliance with federal regulations
  • Worn out or missing equipment

A maritime worker who suffers injury due to the vessel’s unseaworthiness can recover damages from the owner for things like medical bills, lost wages, and pain and suffering.

The Jones Act permits maritime workers to sue their employers for negligence when they are injured on the job. Negligence can be based on things like:

  • Failure to avoid bad weather
  • Failure to keep equipment safely maintained
  • Lack of care in hiring
  • Failure to provide adequate medical treatment
  • Lack of care in supervising or instructing employees

Damages under the Jones Act can include things like lost income, medical costs, and pain and suffering. If a maritime worker is killed on the job, their loved ones may bring a wrongful death action against the employer.

Maintenance and Cure

When a maritime worker suffers an injury on the job, they are typically not eligible to make a traditional workers’ compensation claim. Instead, maritime employers must pay “maintenance and cure” to injured employees.

Maintenance is the cost of daily living, such as rent, utilities, and food. Cure is the cost of the employee’s medical care and treatment. To receive maintenance and cure, an employee need only show that they were injured in the course of their employment. They do not need to prove fault.

How long do I have to file a claim for a yacht or boating accident?

Broadly speaking, most maritime claims are governed by a three-year statute of limitations. The statute of limitations may vary widely depending on the state or country where your accident occurred. Legal Rights Afforded to Injured Yacht Crew

First and foremost, injured yacht crew members are owed medical care and treatment along with payment of daily living expenses during the period of time the crew member is recovering from the injury. This is commonly known as the maintenance and cure obligation and is owed to injured crew members regardless of fault. Should the yacht owners not pay for appropriate medical care and daily living expenses, they may be held liable for the pain and suffering caused for the delay in treatment as well as punitive damages. In addition to payment of medical care and treatment, crew members are entitled to compensation for lost wages as well as pain and suffering if the injury was caused by an unseaworthy condition aboard the yacht.

To prove unseaworthiness, it must be shown that the yacht or a part of its machinery was not reasonably fit for its intended purpose.

This is a strict form of liability meaning that notice of the unseaworthy condition need not be proven. Injured yacht crew may also seek compensation against their employers for negligence under the federal Jones Act. This means that if it could be proven that the employer was negligent and such negligent acts were the cause of the injury, the injured crew member could be compensated for pain and suffering, lost wages and future medical care and treatment.

NYC lawyer, wife among 6 people missing after yacht sinks off Sicily

PORTICELLO, Sicily (AP) —  Specialist cave divers  working in 12-minute underwater shifts were searching Tuesday for six missing passengers and crew, including British tech tycoon Mike Lynch, believed to be in the submerged wreck of a luxury yacht that was  slammed by a powerful storm  and swiftly sank off Sicily.

The sleek yacht, named the Bayesian, was carrying a crew of 10 people and 12 passengers when it suddenly sank near the Mediterranean island that is part of Italy at about 4 a.m. on Monday. One body has been recovered and 15 people survived.

Fire rescue officials have said the six believed to remain in the sailboat’s hull will be considered missing until they are located in the wreckage.

Here’s what we know so far about the sinking and those who were on board.

What happened?

Italian civil protection officials believe a sudden and fierce storm that battered the coast of Sicily in the early hours of Monday whipped up a waterspout in the exact spot where the 184-foot British-flagged Bayesian was moored.

Karsten Borner, the captain of another yacht moored nearby, said he saw the Bayesian during the storm but when the wild weather passed it was gone and he saw only a red flare lighting the night sky, ANSA and the Giornale di Sicilia newspaper reported.

Borner and one of his crew boarded their tender and found a lifeboat carrying 15 people, some of them injured. They took them aboard their yacht and alerted the coast guard.

Rescue authorities said the wreck was resting at a depth of 163 feet about a half mile offshore of the picturesque fishing village of Porticello.

Who was on board?

Among the missing is 59-year-old tech tycoon  Mike Lynch , sometimes described as the British Bill Gates. Lynch was acquitted in June of all charges in a U.S. fraud trial linked to the $11 billion sale of his software company Autonomy to Hewlett-Packard in 2011.

Lynch still faced a potentially huge bill stemming from a civil case in London that HP mostly won during 2022. Damages haven’t been determined in that case, but HP is seeking $4 billion. Lynch made more than $800 million from the Autonomy sale.

A Cambridge-educated mathematician, Lynch made his name running Autonomy, which made a search engine that could pore through emails and other internal business documents to help companies find vital information more quickly.

Lynch’s 18-year-old daughter Hannah was reportedly among the missing. His wife, Angela Bacares, and 14 other people survived.

Among others still missing Tuesday, according to the civil protection agency, were one of Lynch’s U.S. lawyers, Christopher Morvillo of Clifford Chance, and Morvillo’s wife, Neda. Morvillo and his wife both live in New York City. Morvillo was regarded as an elite defense lawyer and was also a federal prosecutor in New York after 9/11.

Law firm Clifford Chance released the following statement about Morvillo’s disappearance.

“We are in shock and deeply saddened by this tragic incident. Our thoughts are with our Partner, Christopher Morvillo, and his wife Neda who are among the missing, and with their families. Our utmost priority is providing support to the family as well as our colleague Ayla Ronald, who together with her partner, thankfully survived the incident. Our thoughts extend to the other passengers and crew and all those affected. We have no further comment at this time. We, and the families, ask that their request for privacy is honored during this period.” Clifford Chance

Also missing was Jonathan Bloomer, the non-executive chairman of Morgan Stanley International, and his wife, Judy. He is the former head of the Autonomy audit committee and testified for the defense at Lynch’s trial.

Bloomer was also chair of the Hiscox Group, an insurer that does business on the Lloyd’s of London market.

“We are deeply shocked and saddened by this tragic event,” Hiscox CEO Aki Hussain said in a statement. “Our thoughts are with all those affected, in particular our chair, Jonathan Bloomer, and his wife Judy, who are among the missing, and with their family as they await further news from this terrible situation.”

Among the survivors was Charlotte Golunski, who said she momentarily lost hold of her 1-year-old daughter Sofia in the water, but then managed to grab her and hold her up over the waves until a lifeboat inflated and they were both pulled to safety, Italian news agency ANSA reported. The father, identified by ANSA as James Emslie, also survived.

The Dutch foreign ministry said a Dutch man survived. The ministry, citing privacy, did not release his identity.

One body was recovered on Monday, identified as the on-board chef.

What is the Bayesian?

The Bayesian was a luxury yacht built in 2008 by the Italian firm Perini Nav. It was known for its single 246-feet aluminum mast — one of the world’s tallest. Online charter sites listed it for rent for up to about $215,000 a week.

Its registered owner is listed as Revtom Ltd., based on the Isle of Man, according to online maritime database Equasis. Lynch’s wife is listed as Revtom’s sole owner, according to corporate registration documents from the Isle of Man.

The yacht’s name is an apparent reference to “Bayesian inference,” one of the two main approaches to statistical machine learning and the one that was used by Autonomy.

What is a waterspout?

Waterspouts are tornadoes that form over water and can happen when a storm moves across warm water.

According to the U.S. National Ocean Service, there are two types of waterspouts — fair-weather and tornadic.

Tornadic waterspouts “have the same characteristics as a land tornado. They are associated with severe thunderstorms, and are often accompanied by high winds and seas, large hail, and frequent dangerous lightning,” the service says on its website.

While scientists haven’t attributed the specific event to climate change, average monthly surface temperatures have been  at record highs for months . Hotter air can hold more moisture, making heavier storms more likely.

Sicily has been baking under intense heat  this summer , and the United Nations’ panel of climate change experts  notes  the Mediterranean is particularly vulnerable to climate change, with warming rates roughly 20% higher than the global average.

What happens next?

As the search for the missing continues, authorities already have begun trying to piece together exactly what happened.

Prosecutors from the Sicilian town of Termini Imerese have opened an investigation, as is normal in such events even when no suspects are identified. To date, they have not commented publicly.

The British Marine Accident Investigation Branch said four of its inspectors were being deployed to Palermo.

A New York City lawyer who died after a yacht sank off the coast of Sicily wrote a haunting post on LinkedIn two months before he joined the doomed voyage.

In one of his only posts on the site , Christopher Morvillo, 59, thanked his legal team after they helped British tech tycoon Mike Lynch win a fraud trial and discussed living “happily ever after.”

Lynch owned the luxury yacht Bayesian , which sank early on Monday.

Five bodies, believed to be those of Lynch, Morvillo, Morvillo's wife Neda, British banker Jonathan Bloomer and his wife Judy have now be recovered by authorities, according to The Associated Press . One woman remains missing. She has not been identified, but Hannah Lynch, Lynch’s 18-year-old daughter, is reportedly unaccounted for.

The remaining passengers have all been found. One person, the ship's chef, died in the storm.

In the LinkedIn post, Morvillo thanked his legal team and his family, and ended with a now poignant flourish.

“And, finally, a huge thank you to my patient and incredible wife, Neda Morvillo, and my two strong, brilliant, and beautiful daughters, Sabrina Morvillo and Sophia Morvillo," he wrote. “None of this would have been possible without your love and support. I am so glad to be home. And they all lived happily ever after….”

Morvillo was a partner at Clifford Chance, a white-collar law firm with offices on Fifth Avenue in Manhattan. He previously worked as a federal prosecutor who investigated the September 11 terror attacks, according to the New York Post .

A statement from Clifford Chance, obtained by US outlet People, read: “We are deeply saddened and still coming to terms with this terrible loss. Our utmost priority is to continue to support Chris's family at this very distressing time. Our thoughts extend to the families and loved ones of all those affected.”

The spokesperson added: “We wish to express our deepest condolences and our love and support to Chris’s family and friends at this incredibly difficult time. We also want to thank the Italian authorities and rescue teams for everything they have done."

The Independent has reached out to Clifford Chance for comment.

Prior to his death, Morvillo and his legal team successfully defended Lynch from fraud allegations brought by Hewlett-Packard stemming from the tycoon's sale of his Autonomy company to HP for $11bn in 2011.

“This verdict closes the book on a relentless 13-year effort to pin HP’s well-documented ineptitude on Dr. Lynch. Thankfully, the truth has finally prevailed. We thank Dr. Lynch for his trust throughout this ordeal and hope that he can now return home to England to resume his life and continue innovating.” Morvillo and his co-counsel wrote in a press release after winning the case.

The 160-foot luxury sailboat was off the cost of Porticello, Italy — near Sicily — when it ran afoul of a small waterspout in the Mediterranean. The Bayesian likely capsized after its mast was broken by the storm, Salvatore Cocina, the head of Sicily's Civil Protection, told CNN .

The ship's hull sank to a depth of 164 feet underwater. Rescue trips to the hull had been slow going as divers can only spend 12 minutes that deep before having to resurface, according to fire rescue officials.

A statement shared by Lynch’s lawyers on behalf of his family read: “The Lynch family is devastated, in shock and is being comforted and supported by family and friends. Their thoughts are with everyone affected by the tragedy.

“They would like to sincerely thank the Italian coastguard, emergency services and all those who helped in the rescue. Their one request now is that their privacy be respected at this time of unspeakable grief.”

Who was onboard tech mogul Mike Lynch's Bayesian yacht?

Six people are missing, including a man dubbed the British Bill Gates, after a luxury yacht sank off the Sicilian coast.

British tech entrepreneur Mike Lynch — freshly acquitted from a decade-long trial — had invited his work colleagues aboard a trip through the Mediterranean coast when a freak storm saw the yacht sink within moments.

Fifteen people escaped from the sinking vessel. The search for the missing continues.

Here's what we know so far: 

What happened?

The Italian coastguard said the yacht — the Bayesian — was anchored off the shore of port city Porticello, near the Sicilian capital Palermo, when it was hit by bad weather sometime after 4am on Monday, local time. 

Eyewitnesses said it vanished quickly beneath the waves shortly before dawn.

Managers of the sailing vessel Bayesian, Camper & Nicholsons, confirmed to the ABC that the Bayesian encountered severe weather and subsequently sank. 

"Our priority is assisting with the ongoing search and providing all necessary support to the rescued passengers and crew," they said. 

"The wind was very strong. Bad weather was expected, but not of this magnitude," a coastguard official told Reuters.

Sicily's civil protection agency head, Salvo Cocina, said a waterspout — a tornado over the water — could have struck the yacht.

"They were in the wrong place at the wrong time," Mr Cocina added. 

Storms and heavy rainfall had swept down Italy in recent days after weeks of scorching heat, lifting the temperature of the Mediterranean Sea to record levels and raising the risk of extreme weather conditions, experts told Reuters.

"The sea surface temperature around Sicily was around 30 degrees Celsius, which is almost 3 degrees more than normal. This creates an enormous source of energy that contributes to these storms," meteorologist Luca Mercalli said.

Captain Karsten Borner of the Sir Robert Baden Powell vessel told journalists he noticed the Bayesian nearby during the storm, but after it calmed he saw a red flare and realised the ship had simply disappeared.

Mr Borner said he and a crew member boarded their tender and found a lifeboat with 15 people, some of them injured, who they then took aboard and alerted the coast guard.

Search crews, including helicopters and divers, are continuing to search the wreckage, lying at a depth of 49 metres.

Specialist divers reached the ship on Monday but access was limited due to objects in the way, the fire brigade said.

The UK Marine Accident Investigation Branch is deploying a team of four inspectors to Italy to conduct a preliminary assessment.

The Foreign Commonwealth and Development office said it was "providing consular support to a number of British nationals and their families".

Sicilian prosecutors have also opened an investigation into the event. 

Who is missing?

There were 12 passengers and 10 crew members aboard the yacht. 

Mr Cocina said the crew and passengers hailed from a variety of countries, including Britain, the United States, Antigua, France, Germany, Ireland, Myanmar, the Netherlands, New Zealand and Spain.

Of the 22, one man is confirmed dead and another six people are still missing. 

They are believed to be inside the hull, fire rescue spokesperson Luca Cari said.

Fabio Cefalù, a fisherman who said he responded to a flare from the vessel but found it sunk, said he stayed at the site for three hours without finding anyone.

"I think they are inside, all the missing people," he said.

Rescue teams recovered the body of the yacht's onboard chef on Monday, identified as Antiguan citizen Ricardo Thomas.

The still missing people include: 

  • Mr Lynch's 18-year-old daughter, Hannah 
  • Jonathan Bloomer, chairman of global financial services company Morgan Stanley International
  • Chris Morvillo , a lawyer at the British multinational law firm Clifford Chance. He worked on Mr Lynch's lawsuit against Hewlett-Packard
  • The identities of the remaining two missing are still unconfirmed

Who was rescued? 

Fifteen people escaped from the sinking ship. 

Eight have been hospitalised and others were taken to a nearby hotel.

Among those rescued were:

  • Mr Lynch's wife, Angela Bacares, who was the owner of the yacht
  • Charlotte Golunski and her one-year-old daughter, Sofia. Ms Golunski is a partner at Mr Lynch's firm, Invoke Capital. She says she momentarily lost hold of Sofia in the water but managed to hold her up above the waves until the lifeboat was inflated
  • Ms Golunski's husband James Emslie
  • New Zealand captain of the yacht James Catfield. He told Italian newspaper La Repubblica the crew didn't see the storm coming
  • A lone Dutch citizen was identified by the Dutch foreign ministry as being rescued, but was not identified

Who is Mike Lynch?

Mr Lynch, once hailed as Britain’s king of technology, was recently freed from a Silicon Valley lawsuit that tarnished his legacy. 

The 59-year-old Cambridge-educated mathematician created Autonomy , a search engine that could pore through emails and other internal business documents to help companies find vital information more quickly. 

He received the OBE for his innovation in 2006. 

He then sold the software to Hewlett-Packard (HP) for $US11 billion ($16 billion) in 2011, with Mr Lynch personally netting $US800 million. 

HP valued Autonomy at $US46 billion ($68 billion) in the months leading up to the deal.

But the deal quickly turned sour after he was accused of forging the software's financial records to make the sale.

As part of a decades-long legal battle against HP, Mr Lynch was extradited to the UK on criminal fraud charges. 

He steadfastly denied any wrongdoing, asserting that he was being made a scapegoat for HP's own bungling. 

He was eventually cleared of all charges in June this year. 

Although he avoided a possible prison sentence, Lynch still faced a bill from a civil case in London that HP mostly won during 2022. Damages haven't been determined in that case, but HP is seeking $US4 billion. 

Following the San Francisco trial, Mr Lynch said he would return to the UK and do what he loved most: "[being with] my family and innovating in my field."

The holiday appeared to be something of a celebration after Mr Lynch's acquittal, with guests including some of the people who had stood by Lynch throughout the ordeal.

Italy Boaters Missing

In a separate act of tragedy, Mr Lynch's co-defendant in the trial, Stephen Chamberlain, died on Monday, after a road accident left him critically injured.

Mr Chamberlain — Autonomy's former vice-president of finance alongside Mr Lynch — was hit by a car in Cambridgeshire on Saturday morning and had been placed on life support. 

What is the Bayesian?

The luxury yacht is 56m long sailboat, with a 75m mast labelled as the tallest aluminium mast in the world.

It was previously named Salute when it flew under a Dutch flag.

The yacht, built in 2008 by the Italian firm Perini Navi, can accommodate up to 12 guests in six suites and a crew of 10, according to online specialist yacht sites. It was last refitted in 2020.

Online charter sites listed it for rent for up to 195,000 euros (about $AU 321,000) a week.

The ship also won a string of awards for its design. 

Ms Golunski said the yacht had travelled through the Aeolian Islands, Milazzo and Cefalù before sinking. 

It is likely the yacht's name would resonate with Mr Lynch because his PhD thesis and the software that made his fortune was based on Bayesian theory.

Details have emerged of the 22 people who were on board the superyacht that sank off the coast of Sicily.

The British-flagged vessel named Bayesian was carrying 12 passengers and 10 members of crew when it got into difficulty in the early hours of Monday.

Seven bodies have now been recovered. The other 15 people on board were rescued.

British technology tycoon Mike Lynch was among the original six people missing. On Thursday, divers confirmed his body had been recovered.

Raised in Ilford, east London by Irish parents, the 59-year-old made millions with the software company Autonomy he set up in 1996.

He had an estimated net worth of £852m, according to the 2023 Sunday Times Rich List, and is believed to have owned the yacht.

Off the back of Automomy's global success, Mr Lynch was given the roles of science adviser to former prime minister David Cameron and non-executive director of the BBC.

The Cambridge maths and sciences graduate sold the firm for £8.64bn to US giant Hewlett Packard (HP) in 2011.

Dubbed the "British Bill Gates", Mr Lynch has been in the headlines in recent months over a high-profile fraud case related to the sale of Autonomy to HP in 2011.

HP accused him of deliberately overstating the value of the company before it was acquired by the American technology firm. Mr Lynch denied any wrongdoing.

In June, a US jury cleared him of all charges .

Hannah Lynch

Mr Lynch's 18-year-old daughter Hannah Lynch was also on board. A body believed to be that of the teenager was recovered on Friday from the yacht wreckage.

She had been on holiday with her parents, having secured a place to study English at the University of Oxford, according to reports.

Her former school, Latymer Upper School in Hammersmith, west London, said they were "incredibly shocked by the news that Hannah and her father are among those missing in this tragic accident" when the yacht first sank.

Mr Lynch's wife Angela Bacares was on board the yacht and was rescued.

The 57-year-old said she and Mr Lynch were awoken by the boat "tilting" at 4am - half an hour before it sank.

Jonathan Bloomer

Jonathan Bloomer, the chairman of investment bank Morgan Stanley International, was confirmed dead on Thursday.

According to the Financial Times, Mr Bloomer appeared as a defence witness for Mr Lynch during his US criminal trial and the pair were good friends. He also chaired Autonomy's audit committee.

The 70-year-old was the chief executive of UK-Hong Kong insurer Prudential until he was ousted by the board in 2005.

He was also chairman of the insurance provider Hiscox.

Judy Bloomer

Mr Bloomer's wife Judy was on the yacht trip with her husband. Divers confirmed they found her body on Thursday.

Mrs Bloomer was a former board member at The Eve Appeal charity, which focuses on gynaecological cancers.

The charity described her as a "brilliant champion for women's health and medical research... an incredible supporter, committee member, and trustee of our charity for over 20 years".

He was Canadian-Antiguan and part of the crew of the Bayesian.

His body was the first to be recovered from the wreckage.

US lawyer Chris Morvillo was among those divers found dead on Thursday.

The father-of-two worked on Mr Lynch's US fraud trial and was a partner of law firm Clifford Chance's US branch.

Mr Morvillo was assistant attorney for the Southern District of New York between 1995 and 2005 and worked on the terrorist investigation into the 9/11 attacks.

In a recent LinkedIn post, he thanked the legal team that helped win Mr Lynch's trial.

Signing off the post, he said: "And, finally, a huge thank you to my patient and incredible wife, Neda Morvillo, and my two strong, brilliant, and beautiful daughters, Sabrina Morvillo and Sophia Morvillo.

"None of this would have been possible without your love and support. I am so glad to be home. And they all lived happily ever after…."

Mr Morvillo's wife Neda died in the disaster alongside her husband.

The 57-year-old had a luxury jewellery brand, which she ran under her maiden name Neda Nassiri.

Ayla Ronald, a senior associate at Clifford Chance, survived the yacht disaster, the law firm confirmed.

The 36-year-old worked alongside Chris Morvillo in helping defend Mike Lynch in court.

Clifford Chance said in a statement: "Our utmost priority is providing support to the family as well as our colleague Ayla Ronald, who together with her partner, thankfully survived the incident."

She is originally from Christchurch, New Zealand, but lives in London, her father told local media there.

He said she was left "very shaken" but "she and her partner are alive".

Charlotte Golunski

Charlotte Golunski was on board the yacht and was rescued along with her one-year-old daughter, Sofia.

She spoke to Italian newspaper La Repubblica, confirming she survived the yacht sinking and told how she kept her daughter alive after she was rescued.

"I held her afloat with all my strength, my arms stretched upwards to keep her from drowning," she said.

"It was all dark. In the water I couldn't keep my eyes open. I screamed for help but all I could hear around me was the screams of others."

The 35-year-old is a partner at one of Mr Lynch's firms - Invoke Capital - and has worked there since 2012, according to her LinkedIn profile.

She also worked at Hewlett Packard, which acquired Autonomy in 2011, for 11 months.

Before that, she studied history at the University of Oxford.

Ms Golunski's partner James Emsley was also rescued from the yacht, according to Sicily's civil protection agency.

The 36-year-old is the father of her one-year-old daughter.

The 51-year-old captain of the yacht spoke to Italian newspaper La Repubblica after he was rescued.

Mr Cutfield, from New Zealand, was taken for treatment at the Termini Imerese emergency unit, where he told the newspaper: "We didn't see it coming."

She was pictured going ashore in Porticello on Monday morning and is from South Africa.

Her mother Heidi told Sky News said she was "beyond relieved that my daughter's life was spared by the grace of God".

"It doesn't make it any easier living with the heartache of those who have lost their lives [or are] missing. My very deepest condolences to the chef's family as they formed a great friendship," she said.

Hotshot New York lawyer Chris Morvillo proved he was a “chip off the old block” when he beat the feds and won an acquittal for UK tech titan Mike Lynch in one of the biggest fraud trials in Silicon Valley history — carrying on his father’s legacy as one of the nation’s top white-collar criminal lawyers, a longtime family friend says.

Morvillo, 59, was on Lynch’s superyacht celebrating his legal victory in the $11 billion fraud case when the ship was hit by a surprise squall and sank off the coast of Sicily on Monday.

He and his wife, Neda, are missing and feared dead.

“I think it would be hard for any young lawyer to come into the business and make a reputation for yourself with the shadow of your dad’s influence,” veteran white-collar criminal attorney Ronald Riopelle, 65, told The Post.

He compared the father and son to baseball stars Ken Griffey Sr. and Ken Griffey Jr.

“It doesn’t happen that often — the son is able to play in the same league as their dad.”

Chris’ father, Bob Morvillo, who died in 2011 at age 73, got his start in the legal world in the 1960s as a federal prosecutor focused on securities fraud and targeted corporate leaders.

His prosecutions helped spark a surge in demand for corporate defense lawyers — which the elder Morvillo filled himself and became a pioneer in the field of white-collar criminal defense.

He represented the likes of Martha Stewart and ex-AIG CEO Maurice R. Greenberg. Former Manhattan District Attorney Cy Vance even worked at Morvillo’s firm — Morvillo Abramowitz Grand Iason & Anello PC.

When Chris Morvillo graduated from Fordham School of Law, he went into the family business and became a white-collar crime lawyer as well — serving as an assistant US attorney for the Southern District of New York before moving on to his dad’s firm and then joining London-based firm Clifford Chance.

Even as Chris Morvillo carved out his own reputation as a litigator, he staked out a very different reputation from his father.

“Bob was a famously great lawyer — but, man, he did not suffer fools easily,” Riopelle said. “Bob was very tough. Chris was full of fun.”

He added: “Chris was just a doll … He was a fun guy. He was nice guy … He was happy-go-lucky guy, good sense of humor. His dad had a bit of a temper and a hard edge. Chris didn’t have that.”

Chris Morvillo, however, proved his legal acumen once and for all in June when he helped secure Lynch — known as “the British Bill Gates” — a total acquittal on fraud charges alleging he’d cooked the books when he sold his company Autonomy to HP in 2011 for $11 billion.

HP later wrote down $8.8 billion from the acquisition and accused Lynch of inflating the value of Autonomy.

Lynch was charged by the US Justice Department, and faced up to 25 years in prison if convicted — but Chris managed to clear him of all federal charges in June after an explosive, three-month trial that was dubbed “one of Silicon Valley’s biggest-ever fraud cases.”

Colleagues of his father said he would have been glowing with pride to see his son secure a rare total victory. Less than 1% of federal charges result in acquittals.

“He would have said he’s a chip off the old block,” said Riopelle, who knew Bob Morvillo for more than 30 years.

Bob even tried cases with Chris over the years, along with his other sons, Scott and Greg.

“Their dad was very proud of their work and I know he’d be very proud of him now,” Riopelle said, adding that Chris was “at the peak of his career in a lot of ways.”

“He was a totally devoted father — he’d be totally heartbroken, as any father would be,” he said.

Morvillo’s firm Clifford Chance said it was “in shock and deeply saddened” by his loss in a statement to the Wall Street Journal .

“We are completely devastated by the news concerning Chris and Neda, and our hearts go out to all of those involved,” the statement said.

Since the Bayesian sank before dawn Monday, six bodies have been recovered from the wreckage lying under 160 feet of water.

Lynch’s body had been identified.

In addition to the Morvillos and Lynch and his 18-year-old daughter, also missing are Morgan Stanley executive Jonathan Bloomer and his wife, Judy.

Ship cook Ricardo Thomas — one of 10 crew members onboard — was found dead shortly after the disaster.

For nearly a week after a violent storm sent a luxury yacht to the bottom of the sea off the coast of Sicily, Italian scuba divers plunged deep underwater, moving through ropes and fallen objects inside the yacht in a desperate search for the six people missing.

On Friday, the recovery of the body of Hannah Lynch, 18, put an end to the wrenching search and to the slim hopes that any of the missing people might have survived.

Ms. Lynch, the daughter of the British tech entrepreneur Mike Lynch, who also died in the yacht’s sinking, was the last person to be formally unaccounted for since Monday after tragedy struck a group that had been celebrating her father’s acquittal in a high-profile fraud case.

There were 10 crew members and 12 passengers on board the 180-foot vessel, the Bayesian, when it was hit by a storm and went down about 4.30 a.m. on Monday, the boat’s management company said on Friday.

Fifteen survived.

The body of the ship’s cook, Recaldo Thomas, was found on Monday, a few hours after a downpour hit the northwestern coast of Sicily, near the port of Porticello, where the yacht had been anchored.

But it took several days to recover the bodies of the six passengers who were apparently trapped inside the yacht: Mr. Lynch and Ms. Lynch; Jonathan Bloomer, the chairman of Morgan Stanley International; his wife, Judy Bloomer; Christopher J. Morvillo, a lawyer at Clifford Chance; and his wife, Neda Morvillo.

On Friday, a round of applause could be heard from the firefighter’s tent set up on the dock in Porticello after the last body was pulled out in what the corps described as a “complex” search operation at a depth of about 165 feet. The firefighters said they had made 123 immersions into the sea to try to retrieve the bodies.

The body bag was then loaded onto an ambulance. A local man had left a small wooden cross on the rocks in front of the dock where the bodies were brought ashore.

Mr. Lynch’s wife, Angela Bacares, was among those who managed to reach the safety of a raft. They were rescued by a sailing schooner that had been bobbing about 150 yards from the yacht.

In a statement, the family thanked the search teams and said that it was enduring a “time of unspeakable grief.”

“The Lynch family is devastated, in shock and is being comforted and supported by family and friends,” the statement added.

As prosecutors from the nearby city of Termini Imerese began conducting interviews with the survivors and possible witnesses, the crew and passengers of the Bayesian have been confined to a local hotel, where the news media have been denied access.

Salvatore Cocina, the head of Sicily’s civil protection agency, said on Thursday that the survivors had turned down the psychological assistance his department had offered to them.

In Porticello, the sprawling presence of rescue services made a haunting backdrop for an otherwise tranquil port town. People sunbathed and ate ricotta-filled pastries, and stores selling sandals and dried fruit opened as normal, while coast guard and firefighting vessels came and went from the shore, taking scuba divers out to the shipwreck.

Other reminders of the tragedy could be seen along the coast, among palm trees and ice cream shops, with groups of onlookers staring out at the sea, now tranquil and flat.

Local and national news organizations have complained that prosecutors have not issued a statement or held a news conference. Prosecutors may shed more light on the yacht’s sinking when they hold a news conference on Saturday.

The marine accident investigation branch of the British transportation ministry was also looking into the shipwreck of the vessel, which was registered in Britain.

One of the major questions is what caused the boat to sink: Was it the fault of the boat maker, of the crew or of a powerful act of nature — or some combination of the three? None of those who were onboard the Bayesian have spoken publicly.

The luxury yacht, built by the Italian manufacturer Perini Navi and launched in 2008, had the second-tallest aluminum mast in the world, according to its makers.

Giovanni Costantino, the chief executive of the Italian Sea Group, which in 2022 bought Perini Navi, has been assertive in defending the design and construction of the yacht, saying that the Bayesian would be “unsinkable” if the proper procedures were followed.

But yacht design experts have cautioned that the lesson of the Titanic, the ocean liner that sank on its 1912 maiden voyage, showed that no vessel, no matter how robust, was worthy of that label.

Nautilus International, a maritime-focused labor union, criticized any implication that the crew had been at fault, especially at this stage. In a statement , the union’s general secretary, Mark Dickinson, said, “Experience tells us that maritime tragedies are always the result of multiple, interconnected factors,” and he urged people to refrain from drawing any conclusions until a thorough investigation had been carried out.

The investigation into the causes will take months, prosecutors said.
