A Spanish Virgin Islands ycht charter vacation takes you on a journey back in time. Until recently the islands were off limits to private yachts as they lie within the territory of the United States Navy. The uncomfortable possibility of either being targeted by a torpedo, or arrested for espionage, kept most charter yachts away for many years, preserving the natural charm and landscape of the Spanish Virgin Islands. Nowadays, the passage is safer and the islands still hold the charm, of yesteryear.

The Spanish Virgin Islands, or Passage Islands are an untouched, pristine Caribbean boating bliss boasting spacious white and mostly deserted beaches, crystal clear turquoise blue water, and healthy intact reefs teeming with fish, coral and crustaceans. With nearly empty anchorages, the Spanish Virgin Islands have the natural charm of the British Virgin Islands forty years ago.

The Spanish Virgin Islands (formerly called the Passage Islands) consists of three major islands of Vieques, Culebra and Culebrita and a myriad of smaller islands located west of the Virgin Passage midway between the island of Puerto Rico and St. Thomas in the U.S. Virgin Islands .

Vieques in the Spanish Virgin Islands

If you're expecting the glitzy nightlife of St Maarten or Antigua though, the Spanish Virgin Islands is not the right destination for you. Culebra is spotted with local cafes and restaurants which may be open, or they may be closed, depending on the proprietor's whim - it's all part of the enchanting island way. A brilliant anchorage by night is Mosquito Bay on the island of Vieques. The water around your charter yacht is filled with glowing organisms turning the entire bay into a luminous 'twighlight zone' at night. You'll also find a more active nightlife in Vieques as the island is two thirds owned by the US Navy. 

As with most of the Caribbean, the Spanish Virgin Islands yacht charter season runs from November through to July. The Caribbean's primary high season is from mid-December to March, when North Americans and Europeans come, escaping the winter. The hurricane season is from late July to early October, although hurricanes are in general rare and more likely to hit the East Coast of the U.S. than the Caribbean. This is the least expensive time for chartering in the Caribbean and there are some really good deals are available. However, as well as running the risk of storms, this time of year also tends to be associated with lighter (or non existent) winds.

ISLA DE CULEBRITA, Spanish Virgin Islands

Bahia de Tortuga lies on the north side of the island of Culebrita. This pristine crecent shaped beach is a half-mile long bordered by palm trees and at the north-western end by "The Spa Pools",  which is an unusual volcanic rock formation similar to The Baths on Virgin Gorda. Culebrita is ringed with reefs and has a total of six beaches.

Culebrita is a wildlife refuge available for daytime hiking to the top where a 125-year-old lighthouse remains at an elevation of over 300 feet.

The town of Dewey is the population center of Culebra with approximately 2000 inhabitants. This is an interesting town to explore with boutiques, gift shops, bar and restaurants. There is a canal which spans the short distance from the Ensenada to the western side of the island that can be safely navigated by dingy. The canal is bordered by restaurants which provide an enjoyable interlude to an afternoon's exploration, or delightful dining atmosphere for an evening out.

There are numerous beaches and snorkeling spots around the island although most on the northerly side are suitable only for day anchorages. Some of hotspots include Punta Melones, Cayo Luis Peña,  Bahia Tamarindo and Bahia Flamingo.

ISLA DE VIEQUES, Spanish Virgin Islands

The island of Vieques is the southernmost island of the Spanish Virgin Islands (SVI) and is about 20 miles long and is four miles across at its widest point. Once home to the U.S. Navy practice bombing and targeting area and still shows the remnants of these activities.

The two main towns of Vieques are Isabel Segunda (sometimes written as “Isabel II”), the administrative center located on the northern side of the island, and Esperanza, located on the southern side. At its peak, the population of Vieques is around 10,000. Vieques is a Spanish spelling of a Native American word said to mean “small island”. It also has the nickname “Isla Nena”, usually translated from the Spanish as “Little Girl Island”, as a reference to its being perceived as Puerto Rico’s little sister island.

The town of Isabel Segunda is the capital of Vieques Island and lies on the north shore of the island. The architecture is fabulous and traditional, boasting an old fashioned charm with rich history. El Fortin Conde de Marisol, the last Spanish fort built in the western hemisphere, is just off the center of town and is now a museum.  Esperanza is a quaint little village that borders the southern side of the island of Vieques with a number of restaurants and bars and a couple of boutiques and gift shops.

To the east of Esperanza are Puerto Mosquito and Puerto Ferro, two phosphorescent bays. This is well worth a visit, especially in the evening when the phosphorescence is spectacular - some say far more impressive than Puerto Phosphorescencia in south-western Puerto Rico. On diving into the water at night, you can make "light angels", a truly unforgettable experience.

Bahia Salinas del Sur is another recommended anchorage, well sheltered most conditions that is a quiet bay with sandy beaches, some mangroves and great snorkeling. It is also possible to hike over to the north shore of the island and swim in Bahia Icacos.

Itinerary Puerto Rico

After awaking and having a nice breakfast, you may want to take one last snorkel on Pyramid Reef before heading off due east to Culebra and Cayo Luis Peña. The sail is about 13 NM and you’ll find your anchorage/moorings on the southwest side of the Island. This anchorage is a sea turtle sanctuary, and features a great snorkeling reef and white sand beach. It’s perfectly fine to stay overnight here, but you may want to continue a couple of miles eastward to Playa Melones on Culebra. Here you’ll find some moorings right off a nice beach with great snorkeling. The advantage of Melones is that you are only a short dinghy ride from the town of Dewey, the capitol of Culebra, where the ferries arrive. Dewey features many small shops and some very interesting restaurants and cafés. Make dinner plans for the Island’s favorite spot, Mamacita’s. This quaint island spot can be reached by dinghy, midway up the channel that cuts through the island. Mamacita’s also offers a live music on the weekends, and impromptu gatherings of local musicians can happen any day of the week.

On day three, set your course to sail on the south side of Culebra, stopping for a snorkel in Carlos Rosario, Tamarindo or Melones. Here you’ll find plenty of free moorings and excellent snorkeling. Afterwards, sail eastwards to Bahia Tortuga on Culebrita Island, acclaimed as one of the top ten Caribbean beaches, not bad considering how many beaches there are in the Caribbean! You’ll want to spend some time here exploring the island. In addition to the picture perfect gin clear water and white sand beach, Culebrita features a historic lighthouse, which you can hike up to. In addition, don’t miss the Jacuzzis or “pozitas” as named in Spanish, natural tide pools along the north side of the island.

After time in Culebrita, take a nice downwind sail to the southern channel to Ensenada Honda, Dulebra’s main harbor. After setting anchor just behind Cayo Pirata, you can dinghy ashore and tie up at the Dinghy Dock Restaurant. Enjoy a late breakfast or early lunch while taking in the view of Ensenada Honda. The Dinghy Dock is a great spot to leave your tender while exploring the rustic town of Dewey. You can do some shopping and replenish provisions or you can even rent a scooter or jeep and explore the Island. You can opt to stay put here for the evening and have dinner at Sally’s, another nice spot, or sail down the bay of Ensenada Honda to the anchorage of Dakiti. Dakiti features many moorings in a calm reef-bound harbor. Just around the bend from the anchorage of Dakiti is Bahia Fulladoza, where you’ll find Club Seaborne, a boutique hotel with one of the finest restaurants on the island, and the Bahia Bay Resort, perfect for drinks and an amazing view. Another great mooring option for the night is Bahia Aldomovar, just outside and to the east of Ensenada Honda. Bahia Aldomovar is a calm mangrove harbor with a coral reef barrier and faces east towards St. Thomas.

On day five you’ll set sail southbound towards the island of Vieques. Enjoy a nice beam reach as you sail towards to the eastern tip of the Island. After rounding the eastern tip , you’ll sail along downwind to Bahia de la Chiva. This remote anchorage spot is unique in its exclusivity as it’s relatively inaccessible without a boat. You’ll enjoy the beauty and tranquility of Bahia Chiva, which features a large horseshoe shaped harbor with an island, Isla Chiva, in the middle of the bay. There’s a long white sand beach to explore and two great snorkeling spots: “Blue Tang” reef and Isla Chiva.

After breakfast and possibly a morning snorkel or hike, cast the mooring line loose and sail leisurely down the undeveloped south coast of Vieques to Sun Bay. Cruise in and find an anchorage on the eastern side of the bay and enjoy some nice snorkeling or a long walk on the beach. Sun Bay is just around the bend from Puerto Real, where the lively town of Esperanza is. Esperanza features its “Malecón” or in English, “waterfront walk”. Here you’ll find quaint little shops and several nice dining establishments along the strip. Lazy Jacks is fun for drinks and bar food. Duffy’s is great for lunch or dinner but if you want a real gastronomic treat, try Bili or El Quenepo, all located along the Malecón strip.

On day seven you’ll continue sailing eastward to Punta Arenas, located on the western coast of Vieques. Here you’ll find lots of coastline where you can drop anchor. In the northwest tip and running down the southwest side of Vieques, you find Green Beach, a beautiful great snorkel location with many turtles. Punta Arenas is a great place to watch the sun set over the Caribbean horizon and if you choose to stay here overnight, it’s only a 2.5 hr. sail back to the SailCaribe base at Marina Puerto del Rey. You can opt to sail back up the east coast of Puerto Rico to Cayo Icacos, just east of the northeastern tip of Puerto Rico. Cayo Icacos has a spectacular white sand beach island with a couple of great snorkeling spots and is only 5NM away from the SailCaribe base. Once back at the base, after re-fueling and de-briefing, you’ll be free to go and explore the multitude of treasures that the big island of Puerto Rico has to offer.

Arrive at Marina Puerto del Rey at 9:30a.m. to board the vessel by 10:00a.m. After accommodating personal belongings and provisions, you’ll begin the technical and chart briefings. This takes about 2-3 hours and once completed you’ll be ready to set sail. You’ll sail about 4 nautical miles to the northeast from Marina Puerto del Rey to Isla Palomino. Here you’ll find a nice harbor with plenty of free moorings maintained by the Department of Natural Resources of Puerto Rico. In the middle of the mooring field is Pyramid Reef, which is at swimming distance from the boat and features a variety of marine life. Other options while moored-off Isla Palomino are visiting the island restaurant and Tiki Bar operated by El Conquistador Resort. You may also like to take a dinghy ride to Cayo Palominito, which looks like a postcard perfect island oasis with its clear turqious waters and white sparkling sand.

Sample Itinerary

Fly into St. Thomas, and board your yacht, at Crown Bay Marina. Spend a relaxing afternoon in Honeymoon Bay on Water Island…swim, snorkel or walk along the beach before enjoying an appetizer and the Captain’s cocktail of the evening. Watch the sun set behind the Spanish Virgin Islands in the near distance, with a passion fruit daiquiri in hand.

Following an early breakfast, we’ll set sail for Vieques (approximately 4 hours), making Ensenada Honda, a secluded mangrove anchorage, our stop for the night. Have lunch, and then spend the afternoon in the kayak disappearing down hidden waterways in the mangroves. You’ll see a variety of bird life, as well as various marine creatures just under the surface of the water, such as upside-down jellyfish, crabs and trunkfish.

After waking up to the sound of gentle waves lapping the side of the hull and an occasional bird calling from the mangroves, sit back in the cockpit and enjoy a breakfast of coconut muffins w/guava jam and a plate of fresh pineapple, accompanied by a pot of hot coffee or tea. When you are ready for some adventure, your captain will take you in the dinghy to spend the morning exploring the various beaches or sandy spits in the area and then unwind by spending the afternoon lounging on the deck with a good book, and a bottle of sunscreen!

The next day, you will make a short sail to Sun Bay, located next to the fishing village of Esperanza. Following afternoon activities of your choice possibly a rendezvous dive with Blue Caribe Dive Center or a snorkel or just sit back and relax while your captain and chef whip up a batch of cocktails and an appetizer. After dinner and the when the sun has set, go on a local boat tour of Puerto Mosquito, which is one of the best bays in the world for bioluminescence! Watch the glowing green wash of the dinghy streaming behind the boat, once we’ve turned off all our lights and stare in fascination at the phosphorescence as illuminated fish zoom past us in all directions like comets streaking through the sky.

In the morning, you will sail to the westernmost tip of Vieques, Punta Arena, for a lunch of barbequed Jamaican Jerk chicken Caesar salads, with fresh mango and homemade croutons. And don’t forget the cold Carib beer!

The next day, you can rent a car and explore the El Yunque national forest, the only tropical rain forest in U.S. jurisdiction of 28,000 acres, 240 species of trees, and a 3,532 foot peak, El Toro. Have you worked up an appetite? Savor a delicious appetizer of freshly made Basil and Olive Tapenade served with crudites andcrackers and a Pina Colada.

In the morning, sail to Culebra (approximately 3 hours) making our way into the harbor and main port of Dewey. Want to stretch your legs? Rent a bike and following only a 30-minute ride, spend the afternoon on the spectacularly beautiful long white sand beach, Flamenco. If you’d like to experience some local cuisine have dinner at Mama Cita’s, which offers an eclectic mix of Caribbean influenced dishes.

Following breakfast the next morning, we’ll make a short sail to Cayo Norte, where you can be put ashore to wander an isolated beach and gather coconuts. Then have a swim followed by lunch in the comfort of you yachts cockpit, as she sits in a little pocket in the reef off of the island of Culebrita. If you feel like stretching your legs…hike up to the lighthouse to enjoy a spectacular panoramic view of Culebrita Reef.

In the morning, l move to another bay on Culebrita, where you can walk the gorgeous sand beaches of White Bay, bask in her turquoise waters (keep an eye out for sea turtles, who love this bay), or explore and swim in the seaward pools known locally as “the Jacuzzis”. Following lunch, we’ll head back to St. Thomas for the night.

Have a lazy breakfast and a swim the next morning, and if you have the desire and time before your charter ends at noon, take a taxi downtown to do a bit of last minute shopping in the duty free port if St. Thomas.  Each trip is tailored to your preferences and the current weather conditions of your charter. Cruising the Spanish Virgin Islands

Sailing to the SVI takes about 5-6 hours downwind from Red Hook, a lovely and rather easy sail west. Culebra is the most cruiser friendly of the two islands as it has been open to cruising for many years. The main town of Ensenada Honda has a nice anchorage for dropping hook and dining ashore with several restaurants from which to choose.

Culebrita is a must see and just a short sail from Culebra heading NE. This lovely island is a nature preserve with adequate moorings available in the south western anchorage. A short and easy hike will bring you to the Northside and Dry Tortuga Bay where you will find a stunning white sand beach where you can enjoy the day. A short hike to the top of Culebrita is worth the walk to see the well preserved vintage lighthouse.

Beyond this anchorage is Sun Bay, a great place to spend the night without the noise of nightlife that you may find at Esperanza, which is the town in the next westerly bay. Esperanza has a few restaurants and options for picking up provisions. Vieques is not set up w/ moorings so anchoring is the only option in the anchorages, although there is talk of moorings planned to be set soon in Esperanza. A highlight of this area not to be missed is the Bioluminescence at Puerto Mosquito. Note: Cruising to Puerto Rico is prohibited on Island Yachts vessels .

The Spanish Virgin Islands are a relatively small cluster of islands and cays located in between St. Thomas and Puerto Rico. They are a part of the US, so no passport is required for US visitors.

The Spanish VI are comprised of two main islands – Vieques and Culebra – and several smaller cays, a few of which you may have also heard of such as Culebrita, Palomino Island, and Cayo Lobo.

Spanish Virgin Islands Charter: From Puerto Rico or the USVIs?

Puerto Rico, Puerto del Rey:

  • Ease of Access: With plenty of direct flights from the U.S., getting here is hassle-free.
  • Sailing Conditions: The route offers more protected sailing. Starting counterclockwise with Culebra gives you some lee protection, while the route around Vieques typically has the prevailing wind and current in your favor.
  • Provisioning: Good options are available, but it's more of a do-it-yourself situation, with no delivery services that I know of.
  • Charter Options: The fleet might is smaller just several catamarans and monohulls
  • Travel Time: It's a bit of a trek from the airport to Puerto del Rey marina, taking about 45 minutes or more.

U.S. Virgin Islands (USVI):

  • Convenience: In St. Thomas, you can be on your catamaran within 15 minutes of leaving the airport - believe me, I've done it!
  • Sailing Route: Expect an easy downwind passage to Culebra. The upwind return to St. Thomas can be challenging, but with luck, you might catch favorable winds, as I did on one trip.
  • Customs: Clearing customs in Culebra is a breeze, especially using the CBP ROAM app, and there's no need to disembark.
  • Provisioning: St. Thomas offers excellent options with delivery services right to your catamaran.

Luxury Yacht Charters: Inclusive Options Await

Here’s something you don’t see on the charter market all too often: larger motoryachts offering all-inclusive rates in the British Virgin Islands and Bahamas.

Typically, larger motoryachts are listed for charter with weekly base rates. Those base rates cover the boat and crew, but not expenses such as fuel, food, drinks and gratuity. The idea is that different clients want to do different things on charter, so the variable costs are adjustable.

By contrast, smaller crewed boats that stick to generally fixed itineraries and can better predict the associated costs—in particular, catamarans in the Virgin Islands—are offered with inclusive rates.

That’s what makes the news so interesting about the 135-foot Horizon Stay Salty and the 120-foot Sovereign Real Summertime. Denison Yachting says these larger yachts are now offering all-inclusive charter packages in the British Virgin Islands and Bahamas.

“This is an exciting initiative to simplify and encourage new charter clients to try one of the most epic travel experiences imaginable,” Ben Farnborough, Denison’s chief operating officer, stated in a press release. “Often we’re made aware that there’s a perception outside of the yachting industry that chartering a yacht is inherently complex. Our goal here is to change that. These all-inclusive Denison charter options are straightforward and seamless.”

The two yachts are being offered with inclusive rates based on fixed itineraries and menus, without the standard preference sheets that charter clients typically fill out so the crew can provision whatever guests request to have on board. Denison’s team instead worked with the yacht owners and crew to determine defined dates, docking prices, fuel costs, cocktail lists and menus.

The idea is similar to the way that Denison worked with Magellan Jets to offer a coordinated package for jet travel from Teterboro, New Jersey, to Nassau, Bahamas, at a fee of $48,000 for 12 passengers.

Stay Salty is a 2010 build that most recently was refitted this year. The yacht accommodates 12 guests in six staterooms, including an upper-deck master. Tenders for watersports fun include a 34-foot Jupiter.

Real Summertime is a 2000 build that most recently was refitted in 2022. Accommodations on this yacht are for as many as 12 guests in five staterooms, including a main-deck master. Onboard amenities include an outdoor cinema, and tenders include a 37-foot Boston Whaler Outrage.

Is there any wiggle room in the all-inclusive plans? Yes, for an extra fee. Denison Yachting says the inclusive rate is intended to appeal to people who want to avoid the planning process, but that guests who want bespoke elements in their all-inclusive charter can work with Denison’s team to accommodate those requests at an additional cost.

To the extent they cannot be so construed, then in the event of any direct conflict between these Terms and any other agreement by or among Broker and Charterer (including but not limited to the agreement executed by Charterer for a Charter Reservation (as that term is defined in Section 1 below), these Terms shall prevail.

Typically, Broker negotiates charter rates in advance with the yacht owner or charter company (“ Charter Provider ”) to obtain cost-effective rates, and facilitate reservations and availability for yacht charters, excursions and travel (the “ Charter ”). Broker also provides services to you by facilitating the booking of reservations for consideration and receives a commission from the Charter Provider (the “ Broker Fee ”). The Broker Fee is included in the pre-negotiated Charter rate provided to you, plus taxes and other fees where applicable. You agree that your payment is for the total amount set forth in the applicable Charter agreement (which Charter Provider may refer to as a Charter Contract, Charter Agreement, Booking Terms & Conditions, Instructions and Terms for Accommodations, as well as other derivations) provided to you by Broker (“ Charter Agreement ”). Upon execution of the Charter Agreement and receipt of the applicable deposit, you will have made a reservation for the Charter that authorizes Broker to facilitate the Charter on your behalf (“Charter Reservation”), including making payment arrangements with the Charter Provider. You further agree that Broker is a third-party beneficiary to the Charter Agreement and shall have the right to enforce such agreement to the extent it deems such enforcement necessary or advisable to protect its rights hereunder or under the Charter Agreement.

  Broker retains the Broker Fee as compensation in arranging your Charter Reservation. The Broker Fee varies based on the amount and type of Charter and/or services provided by Broker.  By making a Charter Reservation, you accept and agree to the relevant cancellation and no-show policy of the Charter Provider set forth in the Charter Agreement. Cancellation and no-show policies vary for each Charter. Carefully read the Charter Agreement and additional information provided to you by Broker. It is expressly agreed by Charterer that the Broker Fee is earned at the time the Charter Reservation is made. Late payment, wrong credit card or debit card details, invalid credit or debit cards, or insufficient funds are for your own risk and account, and you will not be entitled to any refund of any prepaid amount unless the Charter Provider expressly agrees otherwise under the Charter Agreement or in some other signed writing.

  • Charter Rules and Restrictions . Additional terms and agreements will apply to your Charter Reservation and any purchase or rental of equipment or other items, supplies, provisions and travel you may select. Please read those additional terms carefully. In particular, if you have purchased airfare, please ensure that you read the full terms and conditions of carriage issued by the supplier. You agree to abide by the terms of purchase imposed by any supplier with whom you elect to deal, including but not limited to payment of all amounts when due and compliance with the supplier’s rules and restrictions regarding availability, charges, fares, and use of products and services.
  • Payment . All payments must be made by personal check, bank/wire transfer, ACH payment and/or with a major credit card unless otherwise expressly stated. The total price for the Charter Reservation will be billed in U.S. Dollars unless otherwise stated. Some banks and credit card companies impose fees for international transactions. If you are making a reservation from outside of the United States on a US credit card, your bank may convert the payment amount to your local currency and charge you a conversion fee. This means the amount listed on your credit or bank card statement may be in your local currency and therefore a different figure than the amount provided by Broker for the Charter Reservation. In addition, a foreign transaction fee may be assessed if the financial institution that issued your credit card is located outside of the United States. Booking international travel may be considered to be an international transaction by the financial institution or card company. The currency exchange rate and foreign transaction fee is determined solely by your financial institution on the day that it processes the transaction. If you have any questions about these fees or the exchange rate applied to your booking, please contact your financial institution. Broker shall not be liable to you for any such service, conversion, or exchange fee.

  Broker expressly reserves the right to cancel your Charter Reservation if full payment is not timely received as set forth in the Charter Agreement.

  • Cancellation and Rescheduling . You may cancel or change your Charter Reservation as set forth in the Charter Agreement by and among you, the Charter Provider and/or Broker. Please note that some Charter Providers do not permit changes to or cancellation of reservations after they are made, or after a certain date, as indicated in the Charter Agreement. You agree to abide by the terms of the Charter Agreement with respect to your Charter Reservation. Broker will not be responsible for reimbursing Charterer for any previously tendered deposits or payments by Charterer and disclaims all liability for the failure of a Charter Provider to refund or return any such funds.
  • Credit Card Transactions and Chargebacks . If for any reason, any Charter Provider is unable to provide the Charter, or any part thereof, for which you have contracted, your remedy lies against the Charter Provider, and not against Broker. However, Broker will use reasonable efforts to assist you and Charter Provider in reaching a resolution to a dispute between you and the Charter Provider. In the event that your payment has already been transferred from Broker to Charter Provider or to an escrow account, you agree that you will not seek a chargeback against Broker for such amounts transferred. You further agree to indemnify and hold Broker harmless from and against any liability, loss, damage or expense (including without limitation, reasonable attorneys’ fees) that Broker may incur in connection with chargebacks against Broker or under the Charter Agreement and your performance thereunder. If Broker incurs any costs, including but not limited to attorneys’ fees, to recover any payments charged back by your credit card company or other financial institution, you agree that you will be liable for these costs. If your payment is declined for any reason, you agree to settle any amounts owed to Broker via money order, cashier’s check, personal check or bank/ACH transfer immediately.
  • Broker Responsibility . Broker makes arrangements with the Charter Provider. Broker additionally makes additional arrangements with other suppliers for the various components and other services that comprise your Charter (“Charter Suppliers”). Broker is not an agent of these Charter Providers or the Charter Suppliers (and the Charter Providers and Charter Suppliers are not agents of Broker). Broker expressly disclaims any liability for the actions or omissions of the Charter Provider and the Charter Suppliers. The Charter Providers and the Charter Suppliers reserve the right to refuse service to you at their sole discretion. Broker assumes no liability for the acts of the Charter Provider or the Charter Suppliers in refusing service. Broker is not responsible for schedule changes and does not offer compensation for those changes. Broker is not responsible under any circumstances for any injury or damages you may suffer, in connection with sea, air or ground transportation, hotel accommodations, or other travel or excursion services arranged by Broker.

  You understand Broker is not the source or supplier of the Charter or other travel services you requested and acts solely as a broker for the Charter Provider and the Charter Suppliers. You agree that the Charter Provider and Charter Suppliers whose names appear in the information supplied to you are those who are solely responsible for providing the Charter you purchase. You consent to and request the use of the Charter Provider and the Charter Suppliers and agree to not hold Broker responsible should any of them: (i) fail to provide the Charter or travel services you purchased, whether or not such services are listed in the Charter Agreement or otherwise, (ii) fail to comply with any applicable law, or (iii) engage in any negligent act or omission that causes you any sort of injury, damage, delay or inconvenience.

By using Broker’s services, you waive and release any claim against Broker, its affiliated and subsidiary companies, and their respective officers, directors, employees, contractors, and agents, arising out of or in connection with any loss of or damage to property or injury to any person caused by reason of (i) any defect, negligence, or other wrongful act or omission, or any failure of performance of any kind, by any Charter Provider, Charter Suppliers, or any other provider of sea, airline, hotel, ground transportation or any other travel provider connected to or otherwise associated with the Charter, (ii) any claim for inconvenience, loss of enjoyment, mental distress or other similar claim, (iii) any delayed departure, missed connection, substitute accommodation, termination of service or change in fares or rates, and (iv) overbooking, flight or other travel cancellation, lost or misconnected personal property, or any claim arising out of the air transportation portion of your travel, and (v) or any other claim arising out of or otherwise related to the Charter Agreement or services provided by the Charter Provider and the Charter Suppliers.

Excepting only liability that directly arises from the gross negligence or willful misconduct of Broker, you will not hold Broker responsible for any injury, damage or loss you may suffer while on a Charter, whether incurred on the Charter or in connection with any other rental, purchase, excursion or activity, regardless of the relationship of any of the foregoing with the Charter Provider or the Charter Suppliers.

  • Your Responsibility . By booking a Charter with Broker, you agree to defend and indemnify and hold harmless Broker, Charter Provider, Charter Suppliers, and each of their respective officers, directors, employees and agents, from and against any and all claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature, including but not limited to reasonable legal fees, arising out of or in connection with: (i) your breach of these Terms or the documents referenced herein; (ii) your violation of any law or rights of a third party; or (iii) your use of the Broker website.

You will review your Charter Agreement and travel documents for accuracy upon receipt. You understand that it is your responsibility to review the accuracy of all details in the Charter Reservation provided to you, and that you may contact Broker if you have any questions.

You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s).

You understand that Broker recommends purchasing travel insurance to cover certain risks inherent in travel such as supplier bankruptcy and the inability to travel due to a medical or personal emergency.

  • No Warranties . All Charters, products, services, advice and information is provided on an “as is” and “as available” basis without warranties of any kind, either expressed or implied to the fullest extent permitted under the law, including but not limited to, warranties of title or implied warranties of merchantability, satisfactory quality or fitness for a particular purpose. Without limiting the above, no warranty or guarantee is made (i) regarding the acceptance of any reservation request or Charter Reservation; (ii) regarding the availability of Charters, or any other product and/or services through Broker; (iii) that the use of Broker’s website will be error-free; or (iv) regarding the completeness, accuracy, reliability or quality of any information, content, data, service, advice or merchandise provided by Broker or through Broker’s website.

Broker has no special knowledge regarding the Charter Provider’s or Charter Supplier’s financial condition, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel during or otherwise in connection with your Charter.

  • Limitation on Liability . In no event shall Broker, Charter Provider, Charter Suppliers, and/or their respective affiliates, or any employees, agents, officers, directors, members or managers of any of the foregoing (“Broker and Charter Releasees”), be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or in any way connected with, your access to, display of or use the Broker’s website, the Charter or services provided to you in connection with the Charter (including, but not limited to, your reliance upon opinions of the Broker), whether based on a theory of negligence, contract, tort, strict liability, consumer protection statutes, or otherwise, and even if Broker and/or any other of the Broker and Charter Releasees have been advised of the possibility of such damages.

If, despite the limitation above, Broker or the Broker and Charter Releasees are found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then Broker, Charter Provider, Charter Supplier and the Broker and Charter Releasees will in no event exceed, in the aggregate, the greater of (a) the Broker Fee, and (b) One-Hundred Dollars (US $100.00).

The foregoing limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these Terms is found to have failed of its essential purpose. The limitations of liability provided in these Terms inure to the benefit of Broker and/or its providers.

The foregoing does not affect any liability which cannot be excluded or limited under applicable law.

  • Limitation on Time to File Claims . ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF RELATING TO BROKER’S SERVICES OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
  • Waiver . No waiver by Broker of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Broker to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
  • Severability . If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
  • Governing Law and Mandatory Venue . The laws of the State of Florida govern the rights and obligations of the parties to this Agreement and the interpretation, construction and enforceability thereof. You agree that any action or proceeding initiated by Charterer against Broker shall be brought solely in the federal and state courts of Hillsborough County, Florida, and you submit to the jurisdiction of those courts and waive any objections to the exercise of personal jurisdiction over you by those courts. In the event any action or proceeding is initiated by Charterer in a court outside of Hillsborough County, Florida, Charterer agrees to pay Broker’s costs and reasonable attorneys’ fees associated with defending such action or proceeding and waives any and all defenses to the transfer of said action or proceeding, whether jurisdictional or otherwise, to a federal or state court in Hillsborough County, Florida.
