Last Chance to Bid on $250 Million Yacht Seized From Malaysian Fugitive Jho Low

F or sale: a piece of 1MDB history complete with Turkish bath, swimming pool and a helicopter landing pad.

Wednesday marks the last auction day for the Equanimity yacht once owned by fugitive businessman Low Taek Jho and formerly used to host parties featuring the likes of socialite Paris Hilton and Australian model Miranda Kerr.

The 300-foot vessel was put up for sale last month after being seized in March as part of global attempts to recoup assets allegedly lost through the state investment company. Its former owner, better known as Jho Low, has been described as a central figure in the billion-dollar 1MDB scandal that has resulted in worldwide investigations and engulfed Goldman Sachs Group Inc. along with former Malaysian Prime Minister Najib Razak.

While the yacht might appear to be of interest only to those with a quarter billion dollars burning in their pockets, a smooth sale could help ease pressure on Prime Minister Mahathir Mohamad as he seeks to fulfill a campaign pledge to recover funds believed to be missing from 1MDB. The leader has said he aims to recover as much $4.5 billion.

Yacht specialist Burgess, the sole broker for the sale, said there’s interest from both local and foreign investors. Some of those potential buyers have already had to stump up a $1 million deposit to pay for the privilege of surveying theyacht, said Ong Chee Kwan from law firm Christopher & Lee Ong, which is representing Malaysia and 1MDB in the sale.

The Equanimity is just one part of a treasure trove of glitzy possessions once owned by Low and now the subject of legal wrangling and asset seizures around the world. The U.S. has filed forfeiture lawsuits against $1.7 billion of assets that were allegedly acquired with money embezzled from 1MDB, including a $1.29 million heart-shaped diamond and a $3.8 million diamond pendant that Low gave to Kerr, as well as a $3.2 million Picasso painting that Low gifted to actor Leonardo DiCaprio.

Low has previously called the yacht’s seizure “illegitimate,” while Mahathir challenged the vessel’s owners to reveal the source of funds used to buy Equanimity.

The Malaysian Admiralty Court ruled in October that the Malaysian government and 1MDB are the rightful owners after no one from Equanimity Cayman Ltd., the company that held titles to the yacht, appeared in court to contest the claim. The company said in August that it hadn’t received any “legally valid notice” on the hearing.

The judicial sale process means interested buyers must send in sealed bids to the Sheriff of the High Court of Malaya, who also holds a sealed appraisal note setting out the yacht’s court-approved value. The Sheriff will pick the highest offer as long as it’s more than the amount set out in the note, and Malaysia may have to consider another option if all the bids are lower. The yacht has already cost Malaysian taxpayers more than 3.5 million ringgit ($835,000) in maintenance.

Despite its colorful history, the successful buyer of the yacht will get a globally-recognized ownership title “free of mortgage, attachment and all encumbrances,” according to Burgess’ site.

Seizure of Equanimity a turning point in 1MDB saga: The Star columnist

KUALA LUMPUR (THE STAR/ASIA NEWS NETWORK) - It was a psychological victory.

When a RM1 billion-plus (S$335 million-plus) superyacht sailed into Port Klang waters on Tuesday, it marked a turning point in the 1Malaysia Development Bhd saga that has fascinated not only the country but the world since 2012.

Yes, fugitive businessman Low Taek Jho or Jho Low is waging a legal battle (even though he's still at large) with Malaysia over the seizure of Equanimity although the Attorney General's Chambers (AGC) insists the confiscation was done in accordance with Malaysian law.

And yes, it looks like it's going to be a long-drawn-out court battle, but Tuesday was significant because it also marked the day when the Malaysian government first seized an object or item allegedly bought using 1MDB-related funds, as identified by the United States Department of Justice (DoJ).

The Malaysian government secured ownership of the luxury yacht through the mutual legal assistance treaties between Malaysia, Indonesia and the US.

Attorney General Tommy Thomas said the seizure was done at the initiative of the DoJ, which asserted ownership of the yacht on behalf of Malaysia because monies belonging to our country were allegedly used to purchase it.

Earlier, the DoJ had said it was suspending its investigation pending Malaysia's actions.

But lawyers representing Jho Low filed a notice in a US court on Monday that were opposed to any suspension of proceedings and contested the handover of the vessel to Malaysia.

Lawyers appointed by the AGC believe it will take six to nine months for the Admiralty Court to determine the ownership of Equanimity.

So what then is the ultimate aim of the seizure?

It is estimated it will take the government RM3 million monthly to maintain the vessel while it is Malaysian waters.

And if this case drags on for nine months, this works out to a whopping RM27 million!

On Monday, Finance Minister Lim Guan Eng said the government planned to take inventory of items on the yacht and open the vessel for public viewing before selling it "at the highest price".

Personally, I think we should nix the public viewing idea and do an immediate auction as soon as the court rules in our favour to dispose of the vessel and recover a large part of the RM1 billion.

As it is, a steady stream of curious onlookers have been flocking to the Boustead Cruise Centre in Port Klang to get a glimpse of probably the world's most famous yacht.

Larger crowds are expected this weekend, and that is why at least 50 general operations force personnel have been deployed to be in charge of security for the yacht while it is berthed in Port Klang.

Unverified photos, supposedly leaked, of the interior of the yacht are already circulating on social media and its sheer opulence is mind-blowing.

Among the luxurious touches are a helicopter landing pad, a Turkish bath, a pool, spa facilities, a movie theatre, a beauty salon, a gym and a sauna.

Not everyone can afford a yacht; buying it is one thing, maintaining it is another. Only the very rich can purchase a superyacht and this is what sets them apart from other rich people.

You can have a Rolex watch, a Birkin bag or even an apartment in Trump Tower, but owning a luxury yacht puts you in a select club of the mega rich, with the likes of Chelsea owner Roman Abramovich and Khalifa Zayed Al Nahyan, the Emir of Abu Dhabi.

Commissioned in 2014, Equanimity has been sailing around the world for four years now.

Interestingly though, her 18-member multinational crew has only been working on the vessel for the last three weeks.

Its captain, Oystein Senneseth, told reporters that the crew members will stay with the vessel but are free to disembark and return as and when required.

The vessel was seized in Bali in February at the request of US authorities as part of the DoJ investigation.

However, a Jakarta court in April had ruled in favour of the owners after they applied for a court motion to declare the seizure illegal.

In July, Indonesian police seized the yacht again following a formal request for legal assistance from the US.

But because of the sensitive negotiations conducted at the highest levels of different agencies in the three countries, the yacht was finally allowed to sail to Malaysia.

A number of questions need to be asked of the crew. Who hired them? What happened to the previous crew? Have there been any guests on-board for the last three weeks?

These and many more questions should be answered in the coming weeks, even as the court battle proceeds to establish Equanimity's rightful owner.

The writer believes that the seizure of Equanimity is the first step in unlocking the 1MDB puzzle. But until Jho Low is detained or comes forward on his own accord, this saga can never fully be concluded.

Auction for super-yacht, Equanimity, closes in one month and bidders must pay a $1m deposit to take part.

Equanimity, the luxury ocean-going yacht at the heart of the 1MDB scandal, went on sale on Monday as Malaysia ‘s new government tries to retrieve some of the billions of dollars that are thought to have gone missing from the state fund.

The sale is being handled by London-based brokerage, Burgess Yachts.

“The judicial sales process will follow strict guidelines, but essentially shall be by the submission of sealed bids by qualified potential buyers, to be opened by the Sheriff of the High Court of Malaya in November/December 2018,” the broker said on its website.

1MDB lawyer Ong Chee Kwan confirmed the sale on Friday after a series of court hearings.

“Those who are interested to bid need to pay one million dollars as deposit,” he said. The auction closes on November 28.

The $250m Equanimity has been anchored at Port Klang on Malaysia’s west coast since August, after being seized in Bali at the request of US authorities investigating the 1MDB scandal.

The US Department of Justice has said more than $4.5bn was stolen from 1MDB by high-level officials and their associates and used to fund increasingly extravagant lifestyles. At least six countries including Singapore, Switzerland, and the United States are investigating what happened.

‘Impressive beach club’

The US said Jho Low, the Malaysian financier accused of being at the centre of the corruption scandal, bought the 91.5-metre Equanimity with money diverted from the fund and advised its builders on his preferred specifications.

Burgess Yachts said under a dmiralty law, the judicial sale would provide any buyer with an internationally recognised ownership title free of mortgage, attachment and all encumbrances.

Low, who has so far evaded investigators, has issued statements through US lawyers claiming the transfer of the yacht to Malaysia was illegal, but he did not claim ownership, allowing a  Malaysian court to award ownership to 1MDB and the government.

The teak-decked ocean-going ship, which was built by Oceanco in the Netherlands in 2014, can accommodate as many as 22 guests in its suites and boasts an “impressive beach club”, according to Burgess.

It also has an extensive gym and spa facilities with a massage room, hammam and sauna, as well as a helipad.

Former Prime Minister Najib Razak set up the 1MDB fund with Jho Low’s assistance in 2009, but investigators allege huge sums of money were stolen through a web of offshore bank accounts.

Najib has appeared in court four times since his party lost power in May’s general election amid simmering  public anger over 1MDB .

It was the first change in government since the country won its independence from the UK in 1957.

Rosmah Mansor, Najib’s wife, has also been charged. Both have pleaded not guilty and their trials will start next year.

Legal battle over $250 million yacht seized in U.S. fraud probe

JAKARTA, Indonesia -- Indonesia's seizure of a luxury yacht wanted as part of a U.S. probe into the alleged multibillion-dollar theft of funds from a Malaysian state investment company is being challenged by the vessel's owner, police said Monday. National police deputy director of economic crimes Daniel Silitonga said police haven't handed the yacht over to the U.S. since its Feb. 28 seizure because they're waiting for a court hearing after lawyers for the owner of the Cayman Islands-registered Equanimity began a legal challenge.

"Until now we are still awaiting the summons for a hearing," he said. "We are facing some legal issues that have to be resolved first."

The Equanimity, worth $250 million, is among assets the U.S. Department of Justice alleges were bought by Malaysian national Jho Low using money stolen from 1MBD, the Malaysian fund, and laundered through Singapore, Switzerland, Luxembourg and the U.S.

Indonesian police seized the 300-foot yacht off Bali in a joint operation with the FBI.

Silitonga said he didn't yet know the basis of the lawsuit.

A spokesman for Low told Malaysian media in early March that "rather than reflecting on the deeply flawed and politically-motivated allegations, the DoJ is continuing with its pattern of global overreach -- all based on entirely unsupported claims of wrongdoing."

The Department of Justic filed a civil case in June seeking recovery of assets worth several hundred million dollars. Overall, it says more than $4.5 billion was stolen between 2009 and 2014 from 1MBD, which was set up by Malaysian Prime Minister Najib Razak to promote economic development.

Low, an associate of Najib, had no formal role at the fund but considerable influence over it, according to the U.S. court documents.

Equanimity's lavish amenities include a helicopter landing pad, plunge pool, gymnasium and a cinema. It was built in 2014 by Netherlands yacht manufacturer Oceano, which received detailed instructions from Low about its outfitting, according to the civil case documents.

Najib was embroiled in the scandal when it emerged that some $700 million had passed through his personal bank accounts. He denied any wrongdoing and said the money was a political donation from the Saudi royal family, which was later returned.

Tranquility, the 300-foot superyacht Kylie Jenner chartered for her 22nd birthday, is now for sale, with an asking price of $200 million, yachting company Camper & Nicholsons told Business Insider.

Jenner originally rented the yacht in August; according to the charter listing , Tranquility rents for €1.1 million (or just over $1.2 million) per week. Page Six reported in August that the yacht was worth at least $250 million .  

Before its association with Jenner's luxurious birthday party, the yacht was involved in a massive 2018 money laundering and fraud scandal in Malaysia, in which it was seized and sold off by the Malaysian government to recover funds.

Fast forwarding a year later, the yacht was making headlines again, but this time as the vessel that billionaire Jenner cruised on through the Mediterranean.

According to the charter listing, the superyacht costs €1.1 million (or over $1.2 million) per week to rent — which is a lot, but not all that much for a billionaire makeup mogul!

The Tranquility was built by the Oceanco shipyard in the Netherlands and set sail back in 2014. It was awarded "Yacht of the Year Over 82 Meters" at that year's World Superyacht Awards.

The interior was designed by Andrew Winch, an internationally renowned English yacht designer.

The yacht features a number of over-the-top amenities, including a beach club, swimming pool, plunge pool, experiential showers, and a spa with a sauna, a Turkish bath, and a massage room.

Tranquility's master suite and nine additional guest cabins can accommodate as many as 26 guests.

Pre-Jenner birthday extravaganza, the yacht had a surprisingly dramatic history. Per Robb Report, Tranquility was, in its former life, called Equanimity — one of the assets involved in a major money laundering and fraud scandal in Malaysia.

The yacht was, at that time, owned by a fugitive banker named Low Taek Jho (often called Jho Low).

The Malaysian government put the recovered superyacht up for sale shortly after to recover some of the money Low and others stand accused of stealing from 1Malaysia Development Berhad, the now-dissolved Malaysian strategic development company that was once wholly owned by the country's Minister of Finance. Equanimity was eventually sold for $125 million — half its original price.

Low, on the other hand, is currently still a fugitive, sought by the government authorities of Malaysia, Singapore, and the US in connection with the scandal.

Reuters reported in September that the Malaysian authorities said they knew Low's whereabouts and hoped to bring him in "by the end of the year." More recently, Malaysian police said that Low may have been hiding out in Wuhan , the Chinese city at the center of the coronavirus outbreak.

PORT KLANG, Selangor: Equanimity, the US$250 million yacht that has almost become a symbol for the millions of dollars allegedly misappropriated from Malaysian state investment fund 1MDB, arrived back at Port Klang on Tuesday (Aug 7). 

The yacht was returned by Indonesia, whose authorities detained it following a request by the US Department of Justice, which is  investigating alleged misappropriation of 1MDB funds .

The Cayman Islands-registered Equanimity belonged to Jho Low, a  fugitive Malaysian financier  with links to former prime minister Najib Razak. The yacht was  seized in February  off the Indonesian tourist island of Bali.

Speaking to the Bernama news agency, a government lawyer said the yacht was in good condition and that the vessel required at least RM3 million (US$736,000) a month to maintain. 

“It has a crew of 17 including the captain. What we did today is basically hand over the warrant (of arrest of the ship) to the captain,” said lawyer Sitpah Selvaratnam, adding that the crew was allowed to come ashore and that they will help to maintain the vessel.

The Malaysian government intends to auction the yacht off should it be legally awarded to them in order to recover some of the funds allegedly misappropriated from 1MDB.

In a statement, Attorney-General Tommy Thomas said that the seizure of the boat was done in accordance with Malaysian laws. 

"As a result of the Mutual Legal Assistance Treaties between Indonesia, the United States and Malaysia which were activated recently, sensitive and delicate negotiations were conducted at the highest levels of different agencies in the three countries to accomplish this feat," he said. 

Thomas also thanked the US and Indonesia governments, as well as the Republic of Indonesia Police for "extending cooperation and collaboration" during the operation. 

Malaysian Prime Minister Mahathir Mohamad earlier thanked Indonesian President Joko Widodo for his cooperation.

Ties between Malaysia and Indonesia are close with Mahathir visiting Jakarta in June, his first official tour of the region after a  stunning election victory  in May over Najib.

A total of US$4.5 billion was allegedly misappropriated by top-level 1MDB officials and their associates, according to civil lawsuits filed by the US Department of Justice.

The suits allege that US$1.7 billion worth of assets were allegedly bought with the stolen funds, which US officials are seeking to recover.

Those assets include the Equanimity. 

Low was believed to have been sailing around Asia on the yacht before it was seized.

His lawyer called the seizure an "illegal act" in a press release on Monday.

"Mahathir has chosen to bring the asset illegally into a rigged Malaysian system manipulated by a man who only cares about his absolute political rule. It is ultimately justice that suffers," the statement said.

Mahathir said in the video that if any parties claiming to be the yacht's owners could show proof that they bought the yacht with their own money and not stolen money, then they had the right to get it back.

A lawyer representing the Malaysian government, Jeremy Joseph, said that the probe to identify the actual owner or owners of the yacht will take about six to nine months.

"The warrant to detain the vessel was issued by the Kuala Lumpur High Court yesterday," he said.

“Next week, the team of lawyers appointed by the government will get back to the court for the next course of action to identify the real owner of owners,” he told reporters on Tuesday.

Inside Kylie Jenner's Party Superyacht Tranquility

Kylie Jenner is currently celebrating her 22nd birthday on board the 91.5 metre superyacht Tranquility.

The billionaire businesswoman, and founder of Kylie Cosmetics, has been spotted alongside her boyfriend Travis Scott and mum Kris Jenner off the coast of Capri in Italy after chartering the Oceanco-built superyacht Tranquility  for her birthday party, according to TMZ.

How much does it cost to rent superyacht Tranquility ?

A week on board Tranquility costs upwards of €1,100,000. But the world's youngest billionaire can afford to splash out – with Kylie Jenner's net worth estimated at around $1 billion.

Tranquility is managed for charter by  Camper & Nicholsons  who said in a statement: "We value our clients' privacy and just want them to enjoy some tranquility while on board'.

Launched in the Netherlands in 2014, Tranquility was the first superyacht to be built to the new PYC standard. As a result, she can accommodate up to 26 guests, as well as 28 crew members. Her twin 4,828hp MTU 20V4000 M73 diesel engines propel her to a top speed of 19.5 knots. When trimmed back to her cruising speed of 16 knots, Tranquility boasts a globetrotting 5000nm range.

The Winch Design penned interior is inspired by Asia and includes the use of materials like wenge, gold leaf, bamboo and marble. She is commercially approved to sleep up to 22 guests, making her a desirable charter yacht.

There are ten cabins on board Tranquility, including a forward master suite with a private owner's study, and two main deck VIP suites, each with their own private balcony. Another full-beam VIP stateroom can be found on the bridge deck boasting spectacular 180 degree views.

Other star features include a beach club that doubles as a gym, a touch-and-go helipad, and a 2000 square metre swimming pool. For post-party recovery there's even a spa complete with a sauna, Hammam, experiential showers and a plunge pool.

It's no surprise that Tranquility  was a finalist for Displacement Motor Yacht Above 75m at the World Superyacht Awards 2015.
